TERMS, CONDITIONS AND PRIVACY POLICIES
NEWBORN POSED PORTRAITS
If you are booking prior to giving birth (which I recommend) I will allocate a provisional date which can be changed dependent on when you give birth if necessary.
In the event of your baby being unwell I will re-schedule the session. If your baby will then be over 2 weeks old this may be moved to a sitter session or more appropriate photo shoot for an older baby if necessary.
ALL SESSIONS
Your session includes the time and talent of the photographer, professional editing of images and the production of a private on-line gallery for viewing and selecting your images as well as use of my props and accessories during the shoot.
Your online gallery will be ready approximately 3 weeks after the session and will include an average of 30 to 40 images (Baby / child galleries are dependent on how settled your baby / child is during the session.)
Your gallery will be live for two weeks for you to make your selection (once payment has been made in full). Once you have chosen your images you will be sent the high-resolution images as a download.
PARTICIPANTS
You are responsible for your own and your child/children's' safety at all times.
I will pose as well as capture candid moments of all participants during your photo session. I will also always do my best to get children on side and relaxed but I cannot be held responsible for their posing, behaviour, or lack of participation or smiling during the session.
DEPOSIT
By booking your photography session with Jessica Sharp Photography you are entering into a contract and you will therefore need to adhere to the following terms and conditions.
A 50% deposit of the Collection Fee is non-refundable unless Jessica Sharp Photography has to cancel due to unforeseen circumstances, in which case I will refund you in full.
ONLINE
Your online gallery will be available to view approximately 3 weeks after your session. Images will only be kept on file for a maximum of three months after your session so ordering must take place within this time-frame. All our images are protected by copyright law and it is illegal to screen shot, copy or download them from your viewing gallery. Any breach of the above will result in the commencement of legal proceedings.
Your edited portraits will be available in your online gallery for one year, from the date when your viewing gallery is first published. There is a £25 retrieval fee to republish galleries after a year.
LIABILITY
In the unlikely event of total photographic failure or cancellation of the contract by either party the liability of one party to the other shall be limited to the total value of the contract.
IMAGE EDITING
Your gallery will contain a selection of the best images from your session that will have been gently edited. You will not be able to view all the images taken at the session or have access to the RAW unedited files at any time. You may not alter or add to or manipulate an image to be used on Social Media, online or printed. This includes the use of 'filters'. My edited images reflect the quality and style of my work and as such cannot be misrepresented.
Images are edited in line with the style presented on Jessica Sharp Photography website and any online gallery links the Client may have been emailed. Each image is individually digitally edited in Jessica Sharp Photography's style. Digital image editing includes cropping, white balance correction, straightening, exposure and contrast adjustments, colour adjustments, lens correction where applicable and for portrait sessions it includes skin smoothing and removal of temporary skin imperfections as necessary such as baby acne or blemishes. Retouching services e.g. removing an object from an image or changing the physical appearance of a person such as a hair style or tattoo removal is available for an additional charge, if the requested edit is feasible, but such editing is not done as standard as this is not exemplary of Jessica Sharp Photography's lifestyle or studio imagery style. The client is responsible for the personal appearance for each person featured in the photography session as well as the appearance of their home if used as the photographic location.
IMAGES
High-resolution images are provided in your package and can be used to produce multiple print copies, photographic products and to share online in Social Media or via email with family and friends. The 1988 Copyright Act assigns the copyright to the Photographer. You cannot sell the images for commercial or private purposes or enter the images into a competition as copyright remains with Jessica Sharp Photography at all times. Failure to adhere to this would result in a fee of £1000 per image being charged, with payment due within 28 days. Jessica Sharp Photography retains the right in all cases to use the pictures in any manner at any time throughout the world for the purposes of sales, advertising or promotion, of its work.
SESSION ETIQUETTE
Cameras, camera phones, video recorders or any other recording equipment is NOT permitted during a session.
GIFT VOUCHERS
Gift Vouchers available for all collections and are valid for 12 months from the date of purchase. The gift voucher cannot be exchanged for cash or redeemed against the purchase of another gift voucher. Recipients must allow time to book their session before the expiry date to ensure availability for both Jessica Sharp Photography as well as the recipient.
PRIVACY POLICY
Jessica Sharp Photography will never share, or allow to be accessed, shared or distributed, any personal or contact information of any client or enquiry obtained by any means. All contact information is protected on secure systems and password protected at all times.
I do not store credit card details nor do I share customer details with any 3rd parties.
REFUND/CANCELLATION POLICY
A 50% deposit of the Collection Fee is non-refundable as I have to secure a date in the diary for you which potentially may not be re-booked. The balance of your Portrait Collection must be paid in full at least 7 days prior to your session date. Failure to do so may result in you losing your session slot and your deposit.
If you wish to upgrade to a higher Portrait Collection payment will be due once you have viewed your gallery selection.
